Terms of Use

Last updated: October 5, 2026

Welcome to Wheat.

These Terms of Use (“Terms”) govern your use of the Wheat mobile application, the Wheat website at getwheat.app, and related Wheat services.

Wheat is operated by Elan Levy in California, United States.

By accessing or using Wheat, you agree to these Terms. If you do not agree to these Terms, please do not use Wheat.

If you permit a child to use Wheat, you are responsible for that child’s use of Wheat and agree to these Terms on behalf of the child to the extent permitted by applicable law.

1. About Wheat

Wheat is an educational and organizational tool designed to help grown-ups teach kids about earning, saving, budgeting, goal-setting, and spending.

Wheat uses a fictional unit called Wheat.

Wheat is not a bank, financial institution, payment processor, money-transmission service, investment service, or financial adviser.

Wheat does not hold, transfer, deposit, withdraw, invest, or exchange real money.

2. Wheat Has No Cash Value

Wheat credits are fictional and have no cash value.

Wheat credits cannot be:

  • purchased from Wheat;

  • sold to Wheat;

  • exchanged through Wheat for money;

  • transferred through Wheat as real currency;

  • withdrawn as cash; or

  • redeemed from Wheat for money or anything else of monetary value.

A grown-up may choose to associate Wheat credits with real-world privileges, rewards, purchases, allowances, or other activities within their own family, classroom, or group.

Those arrangements are made independently by the users involved. Wheat is not a party to them and does not guarantee or enforce them.

Any dollar values, suggested values, or comparisons shown in Wheat are for educational or organizational purposes only.

3. Real-World Purchases

Wheat does not process real-world purchases.

The Cart and other purchasing-related features are tools for planning or recording activity within Wheat.

If an item is marked as purchased, Wheat may adjust a fictional Wheat balance or record the transaction within the app. This does not mean that Wheat purchased the item, charged the user, transferred money, or completed a financial transaction.

Any actual purchase occurs separately between the user and the applicable seller or retailer.

Wheat does not collect credit-card numbers, debit-card numbers, bank-account credentials, or other payment information for purchases recorded in the app.

4. Grown-Ups and Kid Profiles

Wheat is designed to be set up and managed by a grown-up.

A grown-up may create kid profiles and allow kids to use certain portions of Wheat.

Kid profiles do not require separate Wheat accounts or individual email addresses.

The grown-up managing a group is responsible for:

  • deciding who may access the group;

  • creating and managing kid profiles;

  • establishing allowances, incentives, rewards, and Wheat values;

  • approving activity where approval is required;

  • protecting the Grown-Up PIN;

  • deciding whether and how fictional Wheat credits correspond to real-world rewards; and

  • determining how Wheat is used within the family, classroom, or group.

Kids should use Wheat only with the knowledge and permission of an appropriate grown-up.

5. Classroom and Educational Use

Teachers, educators, and other authorized grown-ups may use Wheat with groups of kids.

If you use Wheat in a school, classroom, educational program, club, or similar environment, you are responsible for ensuring that you have any authority, permissions, notices, or consents required for that use.

Wheat does not represent that use of the app by itself satisfies every school, district, institutional, parental-consent, privacy, or legal requirement that may apply to you.

6. Accounts

Creating a Wheat account is optional unless a particular feature requires one.

If you create an account, you agree to provide accurate information and take reasonable steps to protect access to your account.

You are responsible for activity conducted through your account except where applicable law provides otherwise.

You may not knowingly allow another person to use your account in a way that circumvents Wheat’s security or access controls.

7. Grown-Up PIN

Wheat may allow a grown-up to create a four-digit PIN that restricts access to Grown-Up Mode.

You are responsible for keeping this PIN secure.

The PIN is intended as an access-control feature within Wheat. It is not a substitute for your device’s own password, biometric protection, parental controls, or other security features.

8. Information Stored on Your Device

Family and group information such as kid profiles, balances, allowances, incentives, Funds, Cart items, and activity records is generally stored locally on the device.

You are responsible for maintaining appropriate access to and backups of your device.

Locally stored information may be lost if, for example:

  • Wheat is deleted;

  • Wheat data is erased;

  • a device is lost, damaged, reset, or replaced;

  • browser or application storage is cleared; or

  • a software or hardware failure occurs.

To the maximum extent permitted by law, Wheat is not responsible for the loss of locally stored information resulting from circumstances outside Wheat’s reasonable control.

For information about Wheat’s privacy practices, please review the Privacy Policy at getwheat.app/privacy.

9. Retailer Links

Wheat may provide links or search options that help users locate products at third-party retailers.

These links are provided for convenience.

Wheat does not control and is not responsible for a third-party retailer’s:

  • products;

  • prices;

  • availability or inventory;

  • product descriptions;

  • shipping;

  • returns;

  • warranties;

  • payment processing;

  • customer service;

  • website availability;

  • safety; or

  • privacy or business practices.

A retailer’s appearance in Wheat does not imply endorsement, sponsorship, partnership, or affiliation unless Wheat expressly states otherwise.

Unless a result is expressly labeled Sponsored or Affiliate, you should not assume that Wheat is being paid for its placement.

Transactions with third-party retailers are solely between you and that retailer.

10. Third-Party Services

Wheat may rely on or connect with third-party services necessary to operate the app or website.

These may include services provided by Apple, Google, Rork, Cloudflare, Resend, Squarespace, and other providers.

Your use of certain third-party services may also be subject to those providers’ own terms and privacy policies.

Wheat is not responsible for third-party products or services that Wheat does not control.

11. Apple App Store

If you obtain Wheat through Apple’s App Store, your use of the application is also subject to applicable Apple App Store terms and licensing requirements.

These Terms govern your relationship with Wheat and your use of Wheat’s services. They do not replace or override terms imposed separately by Apple.

12. No Financial, Legal, Tax, or Professional Advice

Wheat is intended for educational and organizational purposes.

Nothing in Wheat constitutes:

  • financial advice;

  • investment advice;

  • tax advice;

  • accounting advice;

  • legal advice;

  • psychological or behavioral advice; or

  • professional financial planning.

Wheat does not guarantee that any allowance, budget, savings strategy, reward amount, incentive value, purchase decision, or other financial concept used within the app is appropriate for a particular person or circumstance.

Grown-ups remain responsible for their own decisions and for how financial and behavioral concepts are presented to kids.

13. User Responsibility

You are solely responsible for deciding how to use Wheat.

This includes determining:

  • which incentives or rewards are appropriate;

  • what values to assign;

  • whether to approve a completed task;

  • how allowances are structured;

  • whether a real-world purchase should occur;

  • how Wheat is used in family or classroom decision-making; and

  • whether Wheat is appropriate for a particular child, family, classroom, or situation.

Wheat does not supervise relationships between grown-ups and kids.

Wheat does not enforce promises, rewards, allowances, agreements, purchases, or consequences between users.

Use of Wheat does not create a fiduciary, financial-adviser, guardian, teacher, parent, therapist, or other special relationship between Wheat, its operator, and any user.

14. Acceptable Use

You agree not to use Wheat to:

  • violate applicable law;

  • impersonate another person;

  • gain unauthorized access to another user’s account or information;

  • interfere with Wheat’s operation or security;

  • distribute malware or harmful code;

  • attempt to bypass Wheat’s security or access controls;

  • abuse or overload Wheat’s systems;

  • infringe another person’s intellectual-property, privacy, or other rights; or

  • use Wheat for fraudulent, deceptive, harmful, or unlawful purposes.

You may not reverse engineer, decompile, disassemble, or attempt to derive Wheat’s source code except to the extent applicable law expressly permits such activity despite this restriction.

15. User-Created Content

Users may enter information into Wheat, including names, incentives, savings goals, Cart items, descriptions, and other content.

You retain any rights you have in content you create.

You grant Wheat only the rights reasonably necessary to process, display, store, or otherwise handle that content in order to provide Wheat’s features.

You are responsible for content you enter into Wheat and should not enter content that you do not have the right to use.

16. Intellectual Property

Wheat and its original software, branding, interface, graphics, design, text, logos, and other original materials are protected by applicable intellectual-property laws.

Except for the limited right to use Wheat in accordance with these Terms and applicable App Store licensing terms, no ownership rights in Wheat are transferred to you.

The Wheat name, logo, visual identity, and related branding may not be used in a way that falsely suggests affiliation, sponsorship, approval, or endorsement.

Third-party names, trademarks, products, and services remain the property of their respective owners.

17. Feedback

If you voluntarily provide suggestions, ideas, comments, or feedback about Wheat, you permit Wheat to use that feedback to develop, improve, promote, or operate Wheat without an obligation to compensate you.

This does not transfer ownership of unrelated material you provide.

18. Availability and Changes

Wheat may change or improve over time.

Features may be added, modified, limited, suspended, or removed.

We do not guarantee that every feature will remain available indefinitely or that Wheat will always operate without interruptions, bugs, errors, delays, or compatibility issues.

We may modify Wheat when reasonably necessary for security, legal compliance, maintenance, product development, or other legitimate operational purposes.

19. Account Suspension and Termination

You may stop using Wheat at any time.

Where available, you may delete your Wheat account through the account controls within the app.

Wheat may suspend or terminate access to an account if reasonably necessary to:

  • prevent fraud or abuse;

  • protect Wheat or its users;

  • address a material violation of these Terms;

  • comply with applicable law or legal obligations; or

  • protect the security or integrity of Wheat.

Nothing in this section limits rights that applicable law requires Wheat to provide.

20. Privacy

Wheat’s handling of personal information is described in the Wheat Privacy Policy, available at:

getwheat.app/privacy

Please review the Privacy Policy before using Wheat.

21. Assumption of Risk and Disclaimer of Warranties

You use Wheat at your own risk.

Wheat is an educational and organizational tool. You are solely responsible for deciding how to use Wheat, including how Wheat credits, incentives, allowances, rewards, savings goals, purchases, and other features are used within your family, classroom, or group.

Wheat and its operator are not responsible for decisions, agreements, purchases, disputes, losses, expenses, misunderstandings, disciplinary consequences, financial consequences, or other outcomes arising from or related to how users choose to use Wheat or information provided through Wheat.

Wheat does not guarantee that any suggested value, reward, allowance, savings goal, incentive, or other amount is appropriate for any particular person or circumstance.

To the maximum extent permitted by applicable law, Wheat is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory.

To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, security, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not guarantee that Wheat will:

  • always be available;

  • operate without interruption;

  • be error-free;

  • preserve data under every circumstance;

  • be free from security vulnerabilities;

  • meet every user’s individual needs; or

  • make third-party websites, products, or services continuously available.

Nothing in these Terms excludes any warranty, consumer right, guarantee, or other protection that cannot legally be excluded.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Wheat and its operator, Elan Levy, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to Wheat or your use of Wheat.

This includes, to the maximum extent permitted by law, loss of:

  • data;

  • profits;

  • revenue;

  • savings;

  • opportunities;

  • goodwill;

  • business;

  • property;

  • anticipated benefits; or

  • other intangible or consequential losses.

This limitation includes claims arising from or relating to:

  • decisions made by grown-ups, kids, teachers, educators, or other users;

  • rewards, incentives, allowances, or arrangements between users;

  • failure by a user to provide a promised reward;

  • real-world purchases or attempted purchases;

  • products purchased from third parties;

  • third-party retailers, websites, applications, or services;

  • inaccurate, incomplete, or misleading information entered by a user;

  • loss or deletion of locally stored data;

  • loss, theft, or damage to a device;

  • unauthorized access resulting from a user’s failure to secure a device, account, email address, or PIN;

  • interruptions, errors, bugs, delays, or unavailability of Wheat;

  • reliance on information, suggestions, values, or features provided through Wheat;

  • disputes between family members, teachers, students, or other users;

  • financial decisions made in connection with Wheat;

  • behavioral or disciplinary decisions made in connection with Wheat; or

  • events outside Wheat’s reasonable control.

To the maximum extent permitted by applicable law, Wheat’s and its operator’s total aggregate liability for all claims arising out of or relating to Wheat or these Terms will not exceed US $100.

These limitations apply regardless of whether a claim is based on contract, tort, negligence, strict liability, statute, or another legal theory and even if Wheat or its operator has been advised of the possibility of damages.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Nothing in these Terms limits mandatory consumer rights available to you under applicable law.

23. Third-Party Products and Services

Wheat may display, mention, link to, or interact with products and services provided by third parties.

Wheat does not manufacture, sell, warrant, inspect, endorse, or assume responsibility for third-party products or services unless Wheat expressly states otherwise.

Any dispute concerning a third-party purchase, product, delivery, refund, warranty, service, or website should generally be addressed with the applicable third party.

24. No Guarantee of Outcomes

Wheat does not guarantee that use of the app will result in:

  • improved financial knowledge;

  • improved behavior;

  • increased savings;

  • completion of tasks;

  • improved school performance;

  • successful budgeting;

  • successful purchases;

  • improved family relationships; or

  • any particular educational, behavioral, financial, or personal outcome.

Individual results and experiences vary.

25. Users Outside the United States

Wheat may be available in multiple countries and regions.

You are responsible for using Wheat in accordance with laws applicable to you.

If you are entitled to mandatory consumer protections under the laws of your country or region, these Terms do not remove those protections.

26. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

However, if applicable law gives you mandatory consumer protections or the right to bring a claim in another jurisdiction, nothing in these Terms is intended to remove those rights.

27. Changes to These Terms

We may update these Terms as Wheat, its features, applicable law, or our practices change.

When these Terms are updated, the Last updated date at the top of this page will be changed.

If a change materially affects users’ rights or obligations, additional notice will be provided where required by law.

Your continued use of Wheat after revised Terms take effect constitutes acceptance of the revised Terms to the extent permitted by applicable law.

28. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.

If possible, an invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable.

29. No Waiver

If Wheat does not immediately enforce a provision of these Terms, that does not mean Wheat has waived the right to enforce that provision later.

30. Entire Agreement

These Terms, together with the Wheat Privacy Policy and any applicable App Store terms, constitute the agreement governing your use of Wheat and its services.

Nothing in these Terms overrides rights that cannot legally be waived.
